RE: Illegal mask mandate illegally enforced by Superintendant (xxxxx) and School District (###)

To the Superintendent, School Board and Those Whom It May Concern;

On behalf of this community and all children enrolled in School District (###), let this serve as a written, official notice that we do not consent to the illegal and discriminatory mandate of arbitrary mask usage in our schools. As minors are not considered adults in the eyes of the law, we are objecting in their stead. Any consent, written or verbal, is only to be obtained from the parent or guardian and only after a complete discussion of the possible risks associated with mask wearing. Mask wearing shall neither be forced, shamed or coerced upon a child that does not have the knowledge, experience or maturity to advocate for themselves. Wearing of any face covering must be ceded to parental discretion, not mandated for every pupil.

The Occupational Safety and Health Administration (OSHA) requires that any employee tasked by an employer to wear Personal Protective Equipment (PPE) be professionally, medically evaluated to ensure they are physically able to function in an environment of restrictive communication and under the physical and emotional duress inherent with masking. They must also be thoroughly trained in the proper use of face masks.

The National Institute of Occupational Safety and Health (NIOSH) sets Permissible Exposure Limits (PEL) for hazardous environments. Carbon Dioxide's PEL is 5,000ppm with Immediate Danger to Life and Health (IDLH) of 40,000ppm. Independent scientists have established that CO2 levels within a fitted N-95 mask far exceed the PEL set by the NIOSH.

The function of federal mask laws under OSHA is to protect both the mask wearer from harm and the organization from liability. According to just one of many studies done by the NIH, the health consequences of mask wearing include but are not limited to: hypoxemia, shortness of breath, acidosis, toxicity, bacterial pneumonia, inflammation, self-contamination, increased stress hormone levels, increased muscle tension, fear, anxiety, insomnia, fatigue, depression, hypertension, cardiovascular disease, cancer, diabetes, Alzheimer's, headaches, decreased immune system protection and death. In fact, the use of face masks historically caused hundreds of employee deaths and is one of the reasons OSHA was created. An organization ignoring these federal regulations is legally liable for any and all damages.

Due to the severity of the possible risks, it is impossible to determine the health effects and specific individual risks of such obligatory face covering edicts without a full medical screening by a federally qualified physician, following Federal law 29 CFR § 1910.134

All children in the care of a tax-payer funded public school deserve the same protection as adults to whom the OSHA regulations apply today. The individuals responsible for issuing the mask requirement without consultation, screening and approval of a physician, are in violation of many state and federal laws. Specifically:

Mandating masks, a medical device, for all students in exchange for state and private donor financial support meets the definition of practicing medicine in North Dakota Century Code 43-17-01-5.b and doing so without a medical license violates 43-17-34.

Organizations that require masks for all employees outside of the protective standards set forth in 29 CFR § 1910.134 are violating federal law. Requiring our children to follow a practice that violates federal law, is knowingly causing the deprivation of a minor, a violation under North Dakota Century Code 14-10-06.

Simply promoting the use of non-FDA approved PPE is unwarranted and illegal, as per Federal and State laws.

This mandate is in direct conflict with Federal Code, Section 360bbb-3€(1)(A)(ii)(I-III), NDCC 43-17-34 as well as other citable statutes.

Misrepresentation of the use of a mask, as being intended for anti-microbial or antiviral protection, and/or misrepresenting masks for use as infection prevention or reduction, is a deceptive practice as defined by section 4 of the Federal Trade Commission Act, 15 U.S.C. 44, and it is an unfair or deceptive act or practice in violation of section 5(a)(1) of the Federal Trade Commission Act, 15 U.S.C. 45(a)(1)

Please note, there is no waiver of liability under the deceptive practices law, even in a state of emergency. Additionally, according to the law, no proof of damages are necessary to secure an injunction against persons or organizations violating State or Federal law. Forcing children to wear masks, or similarly forcing use of any other medical product without consent is illegal, immoral and violates Civil Rights. We can provide multiple medical studies and legal information to support these statements, upon your request.

We will not fail to take the maximum action permissible under the law against your organization, and against you personally if your illegal, oppressive attempts to force innocent children to wear a mask does not cease immediately. We urge you to comply with Federal and State law and advise children and parents of both; the potential risks associated with mask wearing, and that they have the right to refuse.

Any other course of action on your part is contrary to the law and the civil liberties of the children entrusted into your care.

Please confirm no further pressure will be exerted upon students or staff of School District (###) to follow your illegal mask mandate, and that any retaliation against employees, parents, children or families will result in disciplinary action. If such action is not taken, please be aware that you will be subject to the full extent of the law, as your actions are in direct opposition to Civil Rights, Federal, State and local laws.
